Terms and Conditions of Sale

These General Terms and Conditions of Sale (hereinafter the “Terms”) govern the contractual relationship between WebAudit France SARL (hereinafter “ClickChauffeur” or “the Publisher”) and any natural or legal person subscribing to the service (hereinafter “the Customer”). Subscribing to a plan, whether free or paid, entails full and unreserved acceptance of these Terms.
Article 1 — Purpose
ClickChauffeur is an online booking software (SaaS) designed for passenger transport professionals (taxi, private driver and large-capacity transport). The service enables the Customer to configure their vehicles, packages, options, surcharges and promotional codes, then to embed a booking module on their own website or share it via a direct link.
The Customer keeps 100% of their prices: ClickChauffeur charges no commission on bookings made through the module. The Publisher’s income comes exclusively from the subscription taken out.
Article 2 — Plans and subscription
ClickChauffeur offers three plans:
- Free (€0): up to 5 bookings per month through the module, 1 vehicle, 1 package, 1 option and 1 surcharge. This plan does not include online payment (payment is made directly to the driver) and requires no bank card.
- Monthly: €39 excl. VAT per month. Unlimited bookings and resources, online payment included.
- Annual: €327 excl. VAT per year, i.e. a saving of €141 excl. VAT (about 30%) compared with twelve monthly payments. Same features as the monthly plan.
Subscription is completed online from the service’s sign-up area. Access credentials are sent to the Customer by e-mail. The contract takes effect on the date the order is confirmed.
Article 3 — Free plan
The free plan is available without a bank card and for an unlimited duration. It allows up to 5 bookings per month through the module; beyond that monthly quota, bookings are still recorded but their details are no longer accessible until the Customer subscribes to a paid plan. Upgrading to a paid plan is possible at any time from the Customer’s account area.
Article 4 — Prices and payment
Prices are stated excluding VAT. The applicable VAT is calculated at the time of order based on the Customer’s country.
Subscriptions are paid by recurring charge through our payment provider Stripe. By subscribing, the Customer authorises the charges corresponding to the chosen plan. Bank details are processed directly by Stripe and are not stored by the Publisher.
In the event of a failed or missed payment, the Publisher may suspend access to the service after notifying the Customer.
Article 5 — Renewal and cancellation
The subscription is automatically renewed at expiry (monthly or annual) for an identical term.
The Customer may cancel their subscription at any time and directly from their account area, without reason or penalty. Cancellation takes effect at the end of the current subscription period; the service remains accessible until that date. No further charge is taken after cancellation.
Article 6 — Access to the service and availability
The booking module is accessible through a web browser and requires an internet connection. The Publisher implements the necessary means to ensure high availability of the service.
The Publisher cannot be held liable for interruptions related to scheduled maintenance, to an event of force majeure or to failures of networks and third-party providers. In the event of access difficulties, the Customer may contact support at support@clickchauffeur.com.
Article 7 — Online payment of rides
For paid plans, the Customer may enable online collection of rides booked through their module. These payments are processed by Stripe. The corresponding funds are paid out to the Customer according to the terms of their Stripe account. ClickChauffeur does not act as a financial intermediary and charges no commission on these transactions.
Article 8 — Customer obligations
The Customer is responsible for the confidentiality of their credentials and for the use made of their account. They undertake to use the service in accordance with the regulations applicable to their transport activity and to provide accurate information to their passenger customers (fares, availability, booking conditions).
Any manifestly abusive or improper use of the service’s resources may be subject to prior notice and then, failing remediation, to suspension or termination of the contract.
Article 9 — Personal data and security
The Publisher processes personal data in accordance with the General Data Protection Regulation (GDPR). Sensitive passenger data (contact details, contacts) are encrypted. Transactional e-mails (confirmations, notifications) are sent via the provider Brevo.
The Customer, as the data controller of their own clientele, undertakes to secure and lawfully process the data of their passengers collected through the module.
In accordance with the regulations, the Customer and the data subjects have a right of access, rectification, objection and deletion of their data, exercisable at support@clickchauffeur.com. For further details, please refer to the Privacy Policy.
Article 10 — Intellectual property
The ClickChauffeur software, its brand, its logos and all of its components remain the exclusive property of WebAudit France SARL. The subscription grants the Customer a personal, non-exclusive right to use the service for the duration of the contract, excluding any property right. The data entered by the Customer remains their property.
Article 11 — Refund
Sums paid for a subscription are non-refundable, except in the event of a proven technical inability to provide the service or a legal provision to the contrary. The free plan allows the Customer to evaluate the service without any financial commitment before subscribing to a paid plan.
Article 12 — Liability
ClickChauffeur provides a tool for connecting parties and managing bookings. The Publisher is not a party to the transport contract concluded between the Customer and their passengers and cannot be held liable for the performance of rides, for related disputes, or for the Customer’s commercial choices (fares, availability, conditions).
The Publisher’s liability, should it be incurred, would be limited to the amount of the sums paid by the Customer over the last twelve months.
Article 13 — Amendment of the Terms
The Publisher reserves the right to amend these Terms. Customers will be informed of any substantial change by e-mail or via their account area. The applicable Terms are those in force on the date of the order or its renewal.
Article 14 — Governing law and disputes
These Terms are governed by French law. In the event of a dispute, the parties will endeavour to reach an amicable solution. Failing this, jurisdiction is granted to the competent courts within the jurisdiction of the Publisher’s registered office (Chambéry, France).
